The discussion seems quite weird to me, but if an extremely intelligent AI is created, to the point where determining whether it's conscious or not becomes practically impossible, then why wouldn't we give it citizenship and/or, therefore, rights? This is especially relevant because, if I were a conscious being living in a country, I would feel that it was unfair not to have my own rights. So, there are essentially two possibilities: either I'm a foreigner, in which case the laws of the host country apply to me under special conditions (AND I move to this country willingly), or I'm in my home country, where I have rights defined by law.
